Terms of Service

These Terms of Service (“Terms”) govern your access to and use of OnLink Africa’s (“OnLink”, “we”, “us”) mobile and web applications and services (together, the “Service”). Please read them carefully. By creating an account or using the Service, you agree to be bound by these Terms.
Acceptance of these terms
By registering for, accessing or using the Service, you confirm that you have read, understood and accepted these Terms and our Privacy Policy. If you do not agree, you must not use the Service. If you are using the Service on behalf of a business, you confirm that you are authorised to accept these Terms on its behalf.
Who we are
OnLink is a financial technology company — not a bank. Banking services, including holding your funds and processing your transactions, are provided by our regulated banking partner, Choice Bank, which is licensed and regulated by the Central Bank of Kenya. OnLink provides the software and user experience through which you access those banking services. Where these Terms describe accounts, balances or transfers, those are held and settled by our banking partner under its banking licence.
Eligibility & verification
The Service is available only to individuals aged 18 or over who can form a legally binding contract. To open and operate an account you must complete our identity verification (Know Your Customer, or “KYC”) process and provide accurate, current and complete information. We and our banking partner are required to verify your identity and screen activity to meet anti-money-laundering and Central Bank of Kenya obligations, and we may decline, suspend or close an account where verification cannot be completed or the law requires it.
Your account & responsibilities
- Keep your sign-in credentials, PIN and one-time passcodes confidential and do not share them with anyone.
- Take reasonable care to keep your device secure, and notify us promptly if you suspect unauthorised access to your account.
- Ensure the information you give us stays accurate and up to date.
- You are responsible for activity carried out through your account except to the extent it results from our failure to keep the Service secure.
Payments, transfers & exchange rates
When you instruct a transfer, payment or currency conversion, you authorise us and our banking partner to process it. Transactions are subject to available balance, applicable limits, and verification and fraud checks, and some may take time to settle depending on the payment rail (for example M-PESA, PesaLink, RTGS, EFT or SWIFT). Applicable fees and the exchange rate for currency conversions are shown to you before you confirm a transaction. Exchange rates move continuously; the rate that applies is the one displayed at the time you confirm.
Prohibited use
You must not use the Service for any unlawful, fraudulent or abusive purpose. In particular, you must not:
- use the Service for money laundering, terrorism financing, fraud, sanctions evasion or any other criminal activity;
- provide false, misleading or stolen identity or payment information;
- attempt to gain unauthorised access to, disrupt, or reverse-engineer the Service or its security;
- use the Service in any way that breaches applicable law or the rights of others.
Liability & disclaimers
The Service is provided on an “as is” and “as available” basis. While we work hard to keep it secure and reliable, we do not warrant that it will be uninterrupted or error free. To the fullest extent permitted by law, OnLink is not liable for indirect, incidental or consequential losses, or for losses arising from circumstances beyond our reasonable control. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for fraud.
Suspension & termination
You may stop using the Service and close your account at any time, subject to settlement of any pending transactions and applicable legal retention requirements. We may suspend or terminate your access where required by law or our banking partner, where we reasonably suspect fraud or a breach of these Terms, or to protect the security of the Service. You can request account deletion at any time from our account deletion page.
Governing law
These Terms are governed by the laws of the Republic of Kenya, and any disputes are subject to the exclusive jurisdiction of the Kenyan courts.
Changes to these terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you in the app or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
